    Black color of protest in Philippine courts

    Manila (Philippine Daily Inquirer/ANN) - It will be a "black" Monday in various courts all over the Philippines as their employees step up their protests against the administration's plan to reduce the 2012 budget of the judiciary.

    The Judiciary Employees Association of the Philippines (Judea) plans to make known its objection to the budget cut by wearing black shirts or armbands on Monday and succeeding Mondays, according to Judea interim president Mar Aguilar, who is with the Sandiganbayan.

    Malaca?ang, the presidential office, in its budget proposal, reduced the judiciary's 2012 budget to 13.4 billion peso (US$308 million) and transferred the budget for unfilled positions to the miscellaneous personnel benefit fund which would be under the control of the Office of the President.

    A Supreme Court official branded the move a violation of the separation of powers, the court's fiscal autonomy and the policy of non-reduction of the judiciary's budget from previous years.

    According to Judea, the proposal may be intended to put the judiciary under Malaca?ang's thumb. In a statement, the group said this could also be considered interference and part of a move to control the courts, especially after the recent defeat of several Malaca?ang initiatives in the Supreme Court.

    The high tribunal had ruled against Malaca?ang's creation of a Truth commission, and recently stopped its plan to postpone elections in the Autonomous Region in Muslim Mindanao.

    Judea said there should be absolute judicial independence, and the courts should be allowed to conduct their own affairs.

    The budget allocation for the judiciary, a coequal branch of government, should be automatically released, it further said. The court's budget should also be at least one percent of the total national budget, the group added.

    Sen. Joker Arroyo earlier questioned Malaca?ang's move to control part of the judiciary's funds. Arroyo had said that this would give rise to a scenario wherein the Supreme Court would have to beg Malaca?ang to release its funds every time it appoints a new judge.

    President Aquino's spokesperson, Edwin Lacierda, had justified the judiciary's budget allocation, saying the judiciary received additional revenues from filing fees.

    "I hope the judiciary can shed light on this particular judiciary fund," he had said.

    Supreme Court spokesperson Midas Marquez had earlier told the House appropriations committee that the judiciary was seeking 27.1 billion peso for its 2,300 justices and judges and 25,500 court personnel next year, but Malaca?ang slashed.

    He said that in 2007, the judiciary only earned 2.18 billion peso from filing fees, of which 1.14 billion peso went to a special allowance under Republic Act No. 9227 and another 1.04 billion peso to the judiciary development fund under Presidential Decree No. 1949.

    The special allowance mandates a 100-percent increase in salaries and allowances of judges and justices but magistrates had complained that this law (RA 9227) had yet to be fully implemented.

    Marquez had told the budget committee that a first level municipal judge received barely 25,000 peso for a monthly salary, while a Supreme Court associate justice received a salary of 40,000 peso.

    He lamented that various executive orders giving government employees additional increases in the past years were taken from what was supposed to be the 100-percent increase in their allowances as provided by law.

    Marquez said there were 2,200 judges all over the country with more than 600,000 pending cases. The Supreme Court, which has 15 justices, has 6,000 cases pending.

    Marquez said the ideal ratio was one judge for every 10,000 population but currently, only one judge was servicing 50,000 constituents.

      its not like the budget cut will affect their salaries.
      Pero sana lang yung dineduct sa kanila mapunta sa dapat kalagyan like subsidies na dapat binibigay ng government sa mga serbisyong kelangan ng taong bayan (i.e. transportation,health care, etc.)

      This department deserves a budget cut. Health and education must be the priority of the government, this are basic rights of the common people. Providing such basic needs is giving justice to Filipinos.

      Sa MGA " JUSTICES "
      MAHIYA naman kayo JUSTICES every quarter me tinatanggap kayo incentives bukod sa midyear at cristmas bonus, plus extra allowances. pero MAKUPAD talaga kayo kesyo bakasyon, out of town, holidays, meeting seminars, at kung ano ano pang pagkakaperahan.
      Di pa nag kasya nag papa BILI pa ang iba dyan.
      Kahit malayong kamag anak basta me okasyon o sakit ginagawang excuse.
      Ang talagang priority na dapat hatulan at pag aralang kaso nagiging HOW SHAO..DAPAT lang MAG RETIRO NA kayo.. LAHAT.. ng mapalitan ng mga Fresh GRADUATE ng ma i apply ang tunay na pinag aralan ng bagong abogado at nilalaman ng totoong batas.

      HINDI binabaluktot ang tuwid at tinanama ang MALI dahil sa teknikalidad.....
      SAWA na kami sa alibay nyo na tambak ang kaso... dahil sa KAPABAYAAN NINYO YAN..

      sa mga pending cases na ito,
      meron pa ba ang mga kaso bago mag martial law?
      meron pa bang mga kaso noong pangulo pa si marcos?
      meron pa bang kaso noog kapapalayas pa lamang kay marcos?
      kaso noon panahon ni cory?
      kaso noon panahon ni ramos?
      kaso noong panahaon ni erap?
      kaso noong panahon ni glorya?

      ngayong naipunan kayo ng trabaho, eh aangal kayo! di ba't sa lamesa din ng mga husgado nabibinbin ang mga kaso? gaano ba ba katagal dapat pag aralan ang isang kaso ng isang husgado para madisisyunan nya ito?

      sino ang dapat humusga sa hustisya na ipinapairal ng husgado? sino ang dapat mag balanse ng lakas supreme court? sino ang makakapagsabing umaabuso na sila? paano magkakaroon ng pantay na kapangyarihan ang judiciary at executive branch ng goventment kung ang executive branch any tuwirang sinusupalpal ng supreme court sa kanilang mga hakbangin sa pagbabago? saan ang sinasabi nating balanse dito?

      Go go Pnoy, it's just right to reduce the judiciary budget kc di naman nagtatrabaho mga yan, ka sempling kaso eh inaabot ng 5 taon walang nangyari kc kund di may sakit si Judge anak nya or apo nya nasa hospital tama ba yun? tapos tuloy ang sweldo ng taong bayan sa kanila?..ngrrrrrrrrrr........!!!!!!!

      justices, judges and lawyers in the judiciary are all living in luxury. left behind are the poor court personnel. i thought magistrates know also to sacrifice but they are as selfish as the criminals they convicted in their courts. remember... those who have less in life must have more (law?). no, services from government. justices, judges and lawyers are absolutely not qualified. for they should instead be the one to serve and that include the willingness to sacrifice.

      To be more effective, close the court room for one day, hold no hearings, put a sign outside the court room that reads - SORRY MATE NO JUSTICE TODAY - sure you'll get what you want.

      Simple lang yan, kapag may mali sa daloy ng pera, aalisin ang mali, ang mga pinaggagastusan. Halimbawa bond paper mabibili mo lang ng P150, kaso natuklasan mo na P1,500. Anong gagawin mo? Review lahat ng mga budget at bawasan di ba? Opinyon po lamang yan...Ang tamaan kasuhan at ikulong !

      As I read it this is NOT a budget cut but simply a way to prevent an agency from misusing public funds that are generated by unfilled positions in the agency. Marami kasing style ang mga agency to generate excess liquidity so they can use it for "purposes" other than what they originally declared it for. Fill the position and they will get their budget allocation. This is simply a corrupt-practice preventing countermeasure. Ako'y natutuwa at meron itong countermeasure na naiisip ng ating pamahalaan. Sana magtagumpay ang pamahalaan.

      May butas ang piring ng hustisya sa Pinas, kaya ang hustisya sa Pinas ay para sa iilan lamang na malapit sa mga husgado. Sana mapalitan ang mga naka-upo dito na tunay na husgado na walang papanigan kundi ang tamang batas ng bansang Pinas. Isang pusakal ng mangungulimbat ang naghalal sa mga ito sa tigin nyo ba kaya nilang pakulong ang taong naghalal sa kanila? Kaya walang kaso laban sa mga Arroyo and cohorts ang uusad habang ang mga naka upo sa pinaka-mataas na hukuman ay mga halal ni pandak. Lahat ng kaso nito a tiyak kakatigan laban sa gobyerno at kanilang pawawalang sala ang pandak kasama ng pamilya nya at kasabwat, kuha nyo?

      tama lang icut budget niyo tinutulugan niyo lang mga kaso . Nalalagyan pa ang mga hanay nyo. Ang justice system sa Pilipinas ngayon ay puro pera pera ang katapat. Dapat maranasan niyo din mabawasan kita niyo paminsan- minsan para mas mag-porsige kayo sa trabaho niyo.

They must realize also that they are just servants of all the people living in the Philippines, Hence: they cannot remain thieves and crooks living in luxury while the people they serve suffer and die of hunger; where in the crap is true justice ?

      Nanakawin rin lang ng mga nakakataas sa Court, eh, di, pabayaan na lang ma control ng Presidente ang mga lumalabas na pera. Si Corona nandoon pa rin, ang kapal ng mukha noon, talagang yari sa querong kay kapal. Siya ang namumuno para umiyak ang mga empleyado niya para madagdagan ang pangbulsa niya.       without the cut of the judiciary budget, some judges are already betraying their oath of office by receiving a the price for rendering unfair and unjust decision so obvious to even those who doesn't know any thing about the law. are we heading for a clean and honest judiciary or we are promoting increased corrupt judicial system, I wonder when it will happened in our country to give real justice to all and follow the slogan of we are a country of law not a country of men.
