    COMMENTARY: People power

    Manila (Philippine Daily Inquirer/ANN) - Someone asked me why I've thrown my support behind the Philippine president's public indictment of Chief Justice Renato Corona and call for the people to voice their sentiments through some kind of People Power when there's an impeachment going on.

    For a couple of reasons.

    First because like President Benigno Aquino III, or like most Filipinos, I've gotten flustered by the pace and shape of the proceedings. The impeachment court began by recognising fundamental premises. One was that it was not an ordinary court or a court of law. It wasn't merely that an impeachment court is an extraordinary court assembled to do an extraordinary thing, which is to try an extraordinary official. It was also, looking at it from another angle, that the senator-judges were not lawyers¿or at least most of them were not so. They were not supposed to talk like lawyers, they were not supposed to act like lawyers, they were not supposed to look at things like lawyers. They were supposed to talk and act and look at things the way we, the citizens, did.

    Two, which bolstered that understanding, was that the court existed only to reveal the truth, to uncover the truth, to bring the truth to the light of day. That was to be the guiding spirit of the trial. Prosecution agreed so, defence agreed so, even Renato Corona agreed so. The point was not to hide anything, the point was to leave no stone unturned.

    Then before you knew it, defence had managed to prevent the court from talking about Corona's ill-gotten wealth because the prosecution had failed to specify that explicitly in its articles of impeachment. You can talk about Corona lying through his teeth about his statements of assets and liabiltiies (SALN,) but you cannot talk about Corona lying through his teeth about his SALN to hide his ill-gotten wealth.

    Before you knew it, defence had managed to prevent the court from opening Corona's dollar accounts. Never mind that it put privacy in one's dollar deposits on par with privacy in one's own home¿it was absolute, said Senator Miriam Defensor-Santiago¿mind only the mind-boggling "colonial mentality," as we like to call it, it perpetuates.

    What earthly, or hellish, reason makes pesos open season and dollars as closed as Fort Knox? The corrupt are more likely to hold peso than dollar accounts? You want an impeachable crime, there is an impeachable crime: Trampling on the flag. And the senator-judges who voted for the Supreme Court's TRO are guilty of it.

    Then before you knew it, everyone was talking like lawyers, acting like lawyers, looking at things like lawyers. No longer demanding that the truth be the horse that pulled the cart of law to wherever it would take it; agreeing instead that the law be the horse to drag along the cart of truth whenever it felt like it.

    I sympathise with Aquino's impatience. I empathise with Aquino's dismay. I support his call for the people to do something about it.

    Second because we can do something about it. We have People Power, whose anniversary we mark this Saturday, whose spirit we need badly to rekindle today.

    Is it bypassing the impeachment? Is it screwing the impeachment?

    Not at all.

    At the very least, defence itself isn't confining its defence to the impeachment court. After complaining against "trial by publicity," it went on to do the worst version of it, accusing Aquino on the strength of the word of an unknown source of trying to bribe off the senator-judges. As it turned out, the senator-judges voted in favour of the TRO.

    So what did that mean? It was really the woman in the Hannibal-Lecter mask who did the bribing? Defence got off very lightly with the cheap shot.

    At the very most, People Power does not contradict representative democracy, it complements it. People Power does not diminish representative democracy, it replenishes it.

    It was Juan Ponce Enrile who talked about representative democracy at the beginning of Corona's trial. His point was for the public to leave the impeachment well enough alone. We are a representative democracy, he said, we have them to do the job for us.

    Not really. In a real representative democracy, the people do not disappear after elections, the people do not go mute outside of elections. They are part of the fabric of everyday governance. They participate fully in everyday political life. They do that by way of public opinion, which shapes policies and decisions as powerfully, if not more so, as what the secretaries, the legislators and the justices themselves do.

    When they say they will write their congressmen, they do not expect to be ignored, they expect their congressman to listen. When they pay their taxes, they expect their taxes to go back to them, it is their money after all, and not to be divided as spoils by officials. When they bristle at an official who behaves egregiously scandalously, they expect that official to slink away in shame.

    Here, what "representative democracy" really means is that after voting, the people slink away, if not in shame, at least in silence. After voting, the people get out of their officials' way. Try writing your congressman and see where it gets you.

    People Power has always been our way of making up for that. Although so far we've resorted to it only in dire extremities. I've always thought People Power could evolve into something akin to the way the citizens of truly democratic countries are able to be heard in everyday life.

    But that's another story. For the nonce, we do have another dire extremity in our hands, the very future of this country being at stake in the drama unfolding before us today. We cannot afford to be mere spectators in it. We can do something about it.

    We are the people, we have the power.

      I've been a witness to the two people powers and one mob power, and after that latter "people power" it was tarnished by the people who represents itself. In short, another people power today to bring down a Supreme Court Chief Justice is not a very good idea to think with.

      I'm not against people power, but, after 30 years of my life seeing these events, I think the so-called people power became no more than just another political weapon to oust someone. And in this fragile democracy we have and how majority of our people vote in elections, another people power will surely result to a mob rule. Sadly, a mob rule with PNoy as it's head. We should remember that we live in a democratic state yet we have rules, laws and a constitution to abide with. And another revolution just to oust a Chief Magistrate will surely weaken the judiciary branch.

      Pnoy should learn to restrain himself and respect the Impeachment process, because that's the rule and the proper venue to take out a very high official. The President himself should learn to respect the process. It is now in the Senate and let the justice roll in accordance to our constitution. He should let the Senate as an Impeachment Court to do its job, and he, do his own homework.

      Majority of the people are now sick and tired for this calls of People Power. Little by little it became the voice of the mob than the "true" voice of the people. We are becoming the laughingstock of the international community due to this call.

      We people should respect the Impeachment hearings, even if it is so tedious for there in so short-cuts to this process. Every one should respect the system in placed, we should respect the Senator-Judges and accept their verdict weather it's an acquittal or conviction. For we people not even the Chief Justice nor the President himself is above the law and our constitution. And another People Power will result to a mob rule and weaken our constitution.

      if you give the judgement to the verdict to a mob of rabid partisan citizens
      you get chaos disguised as justice or voice of the people

      PEOPLE POWER becomes easy solution to the problem. It creates a belief that the problem that cannot give the answer in our favor can be overturned using the people power as long as the majority is with us. Doing so, you disregard the correct way in respecting the due process of the law. You have forgetton that Arroyo is the product of people power. People Power is not the solution. Planting the culture of honesty to our children is the best solution. I do believe that the corruption in the country is common because in the school the students are CHEATING.

      PEOPLE POWER- we have it all wrong. BY the people....FOR the people etc. does not mean we as a mass would take action, with sticks and stones and molotov cocktails. That would be a mob rule! And if successful, will also be run by mobsters.

      BY the people- means we elect somebody with integrity and character who will represent us... and he will act FOR us ( the people ) to the best of his abilities , of course. These elected individuals (hopefully) will be OUR voice in the government. They then become our POWER.

      Simple lang naman ang problema nating mga pinoy, masyado tayong praktikal. Bakit ka pa nga ba mag-aantay sa pagkahaba-habang proseso ng impeachment kung pwede ka naman lumabas at mag-flanking sa EDSA para mapatalsik ang gusto mong patalsikin? Syempre yun ang mas praktikal na gawin. Hindi lang naman sa impeachment applicable yan eh sa pang-araw araw na buhay din isipin nyo. Ayaw lang nating sundin ang batas dahil matagal ang proseso nito. Ayaw lang nating sundin ang batas dahil di natin maintindihan ang teknikalidad nito.

      Kahit na guniguni pa lamang ako nung panahon ng EDSA1 at totoy nung EDSA2, kapag nagkaroon pa ng isang EDSA baka ikahiya ko na ang pagiging Pilipino ko. Puro tayo parte ng mga naghahangad ng pagbabago pero wala sa atin ang gustong magsimula ng pagbabago. Kung natuto na tayo sa mga pagkakamali natin sa nakaraan, maunlad na tayo ngayon. Huwag nating hayaang magkaroon pa ng EDSA1001 para maisip nating hindi praktikalidad ang solusyon sa lahat ng problema.

      At ang tingin ko kay Pnoy naman, masama naman sigurong manggaling ang ganyang mensahe galing sa pangulo ng Pilipinas. Kung may reklamo sya sa tinatakbo ng impeachment trial tingnan nya muna kung bakit. Sa totoo lang natatakot na ako sa ginagawa nya. Mister president you are our leader you're suppose to lead us not leading you.

      What a complete idiot to even think that they fool the people once again. People Power actually was a big mistake. The true essence was not adhered to and our country became more undisciplined.
