    Corona prosecutors to appeal SC ruling on confidential files

    The House prosecution team will ask the Supreme Court to reconsider its ruling rejecting the panel’s request for access on confidential court records supposedly to be used as evidence in the impeachment trial of Chief Justice Renato Corona.

    Bayan Muna Rep. Neri Colmenares, one of the prosecutors, said the panel will appeal the decision since it is an “attack on the constitutional power of the impeachment court” and a violation of due process rights of the complainants’ access to the courts.

    “It is absurd because it prohibits the disclosure of anything ‘pre-decisional.’

    This means all evidence, including mere administrative matters, in a case that has not yet been ‘decided’ is confidential and therefore, cannot be accessed by anyone including the impeachment court,” he said in a statement.

    He added the prosecution will particularly question the SC’s decision to bar its personnel, such as clerk of court Enriqueta Vidal, from testifying on administrative matters.

    Last February 14, the SC came out with a resolution prohibiting the release of confidential court records to the prosecution team.

    Corona, who heads the SC, is currently being tried in the Senate for betrayal of public trust, culpable violation of the Constitution and graft and corruption.

    Sereno Colmenares likewise said that the panel will also challenge the high court’s views on judicial privilege, which prohibits justices from revealing details on SC deliberations.

    The prosecution asked the Senate impeachment court last week to invite Associate Justice Maria Lourdes Sereno to Corona’s trial to shed light on how the high court issued a temporary restraining order (TRO) against the implementation of a watch list order on former President Gloria Macapagal-Arroyo last November.

    “Mano ba namang hayaan nila siyang [Sereno] tanungin ng dalawang tanong lang: nandoon ka ba noong deliberasyon noong Nov. 15 at yung sinabi mo ba sa dissent mo ay totoo sa iyong personal knowledge? Tapos na,” the lawmaker said.

    The Senate earlier junked the prosecution’s plea to summon SC justices to the impeachment trial.

    But even before the Senate impeachment court can decide whether or not to invite Sereno, the defense camp already plans to block the magistrate’s testimony in Corona’s trial.

    Defense spokesperson Tranquil Salvador III said that while Sereno can voluntarily appear before the impeachment court, she is not allowed to talk about what took place during the SC deliberations on Mrs. Arroyo’s TRO.

    “[Even] if she as a witness submits to the court voluntarily, we doubt whether she can testify or be subject to written interrogatories on matters covered by judicial privilege since only the SC as an institution can waive it,” he said.

    Lawyer Ramon Esguerra, another member of the defense counsel, said Sereno’s appearance in the trial may expose her and the SC to “certain risks,” since the high court’s internal rules prohibits the disclosure of how the SC came up with its rulings. - KBK, GMA News

        innocence is simple yet a broad word in our society, we have to follow rules and procedures or something, dont blame Cj we have rights u knw, blame it on the prosecution for making the an impeachment complaint with lots of potholes and irregularities, the prosecution itself are not following the rules it made. if u knw what i mean

        We as observers should follow the presumption of innocence to all accused and to the laws that protect the rights of individuals. State should not circumvent and do away with the laws and do away with the presumption of innocence or else we will be no different from imposing Martial law. Assuming he shows his dollar account and it shows just $700 dollars, nobody will still believe as doubters have already been biased and brainwashed into believing he is still hiding his supposedly ill gotten wealth of which they are accussing. So since its a no win situation, if I were CJ, I would just invoke my right from self incrimination and keep my mouth shut. At the end, its not the people who will judge his innocence but the senator judges in the impeachment court.

      para kayong bata ngawa ng ngawa, papaniwalaan lamang kayo. bakit kay sereno lang ang kailangan nu, may mga kasama pa namang ibang justices. sa botohan ba, ung dehado ang dapat sundin o majority? o sinisingil na kau ni Pnoy kasi wala kaung mapatunayan. laki nga naman mga natanggap mula sa kaban ng bayan. aminin! sabi nga ni FVR, "corona is not the solution against poverty". mga proyekto at kaunlaran ng bansa nasa kamay ng Pangulo at ng mga cabinet secretaries, wala sa jurisdiction ng SC.

        no problem with the setting the truth free but it must be done in accordance with the rule of law if u know what i mean, or else we wont go anywhere without order, firstly the prosecution is to blame for making an impeachment complaint with lots of potholes and irregularities, next my gosh are those prosecution really the best personalities that they can get to represent the panel? frankly speaking if the case is really strong one only needs 1 or 2 complaints and 1 or 2 witnesses to do the job........i mean cant u just tell?

        Don, the law is used not to cover but protect that "something". What we are seeking is a "legal truth" not the "real" truth as this is beyond our competence as humans. Only God knows what TRUTH is.

      What is the relevance of Justice Sereno's testimony on the charge being alleged by the prosecution? Will a lone dissenting opinion of an SC justice be suffice and substantial to outweigh the concurring opinions of eight justices or the majority? If so, under what considerations or bases?

      This action of the prosecution only shows its ineptness and utter disregard to governing rules of the impeachment court and the SC.

      It's quite clear that Enrile and Meriam are on Corona side..So, at the end of the day this impeachment trial will go to waste..nothing will be proven and another corrupt will be freed..and the lesson we would learn that corruption in our country will continue more. These 2 senators should not be voted for another term..
