Irked senator-judges challenged Chief Justice Renato Corona's defense team to reveal their source on the alleged Palace attempt to bribe them.
“Pangalanan niyo kung sino ang nagsabi. Magpakalalaki tayo dito. Hindi biro ang ginagawa namin dito,” Senator Jinggoy Estrada told the defense on Monday.
Lawyers of Corona on Sunday claimed Executive Secretary Paquito Ochoa, acting in behalf of President Benigno Aquino III, supposedly offered senator-judges P100-million worth of earmarked projects each if they would vote to defy SC’s TRO.
But citing attorney-client privilege, the defense refused to identify their “credible” source.
“You are all accountable for attempting to besmirch this institution. You have crossed a line. Malaking insulto ito sa institutsyon at sa aming mga senator-judge,” said Estrada, and claimed he did not receive a call from Ochoa for that purpose.
Defense lawyer Jose Roy III apologized and clarified that they never meant taint the integrity of the senators.
“Hindi namin nais palabasin na kayo ay nasuhulan. Your integrity has never been in question in our eyes. There was no malice in the part of the defense. We did that as a matter of principle,” Roy said.
Senator Alan Peter Cayetano, however, questioned defense's timing.
“Kapag bumoto kami to defy the TRO, ang labas ay nasuhulan kami. Kapag naman bumoto kami to obey the TRO, ang labas natakot kami sa alegasyon ninyo. The mere fact that we have to stand here and deny whether we decide in favor or not, nalagay na kami sa alanganin,” Cayetano said.
He added, “You made us susceptible to allegations of bribery. Ang implikasyon tuloy kami’y nauutusan lamang dito ng pangulo.”
Senator Pia Cayetano likewise noted that it is the counsels' duty to uphold the court's dignity, not to taint their names.
Cayetano added that unless the defense were able to divulge their source, the allegation would only serve to promote distrust to the court.
The Senate, as recommended by Senator Antonio Trillanes, ordered the defense to explain in writing why they should not be cited in contempt of the court.
