    Gates to testify in $1B lawsuit against Microsoft

    SALT LAKE CITY (AP) — Microsoft's Bill Gates was set to testify Monday in a $1 billion antitrust lawsuit accusing the software maker of duping a competitor prior to its rollout of Windows 95.

    Gates arrived early Monday morning at the Salt Lake City federal courthouse, where he'll be the first witness in his company's defense in a monthlong trial.

    Utah-based Novell Inc. sued Microsoft in 2004, claiming the Redmond, Wash., company violated U.S. antitrust laws through its arrangements with other computer makers when it launched Windows 95. Novell says it was later forced to sell WordPerfect for a $1.2 billion loss.

    The company argues that Microsoft co-founder Bill Gates ordered company engineers to reject WordPerfect as a Windows 95 application because he feared it was too good. WordPerfect's share of the market then plummeted from nearly 50 percent to less than 10 percent as Microsoft's own office programs took hold.

    Novell attorney Jeff Johnson has conceded that Microsoft was under no legal obligation to provide advance access to the Windows 95 operating system so Novell could prepare a compatible WordPerfect version. Microsoft, however, enticed Novell to work on a version, only to withdraw support months before Windows 95 hit the market, he said.

    Microsoft lawyer David Tulchin said Gates decided against installing WordPerfect because it threatened to crash Windows and couldn't be fixed in time for the rollout. He argued that Novell's missed opportunity was its own fault, and that Microsoft had no obligation to give a competitor a leg up.

    "Novell never complained to Microsoft," Tulchin said during arguments Friday. "There's nothing in the evidence, no documents."

    Johnson maintains Novell was tricked in violation of federal antitrust laws so Microsoft could monopolize the market.

    "We got stabbed in the back," he said.

    Microsoft is seeking a dismissal, calling the claims groundless.

    Throughout arguments Friday, U.S. District Judge Frederick Motz openly expressed doubts that Novell's claims had merit.

    "I don't see why I have to give a product to a competitor so he can beat me," Motz told Novell attorneys.

        Dillion the first program I learned was Word Perfect,it had every feature that you would want,then came Microsoft office,it seems to have the same stuff as Word Perfect in it,but it took a while to catch up,No doubt Mr.Gates played with Word Perfect company to slow down there approach and then used his own version,which is now office,Microsoft has a track record of hurting the competition any way they can,as long as it helps Microsoft,Office is not any better program than Word Perfect was.
        Open Office is the program you want to have and use now,of course if you want to pay the extra money, open office is free while Microsoft Office is in the hundreds,you can still save all your files in the Microsoft format,to use at the office,without paying Bill Gates.
        Bill Gates got all his programs by doing low life things to get their companies to sell to him,their is no low they won't go to.

      Right now I am having a battle with Norton. After they charged my credit card $47 to automatically download the 2012 version, I found out they were downloading the same 2009 version over and over for the past 3 years. They admitted it in their emails which I saved. If you don't buy the disk & do it yourself, you'd better check to see what you got from them.

        It takes a long time to get cases through court. Apparently this one doesn't have enough merit to make it very far, however, not because it didn't happen but rather because Microsoft didn't leave any loose ends laying around, or emails, that could trip them up later.

      This case is all wrong. Microsoft/Windows would NEVER negotiate with a competing company like Novell. If Bill Gates couldn't create a way to utterly crush the competition and buy them out cheap, he would use another tactic. Get a secretary to buy a couple copies of the competitor's software locally. They bring it back to Microsoft, reverse engineer it, figure a way around the competitor's patents. BAM! a new Microsoft product. Word for Windows. And considering all the applications they have "borrowed" from other competitors, and did that very same process. Well, whatever you pay for a Microsoft Office product is mostly markup. The only writing of software by Microsoft is most likely hacking and stealing from competitors. Just like the operating system was "bought" by Microsoft, hacked some to make it slightly different, and sold to IBM. If they were smart enough to buy the original Windows program, instead of just getting a license to sell it, IBM would be the world's richest company.

      It's the beauty of coding. You can do things deep down in the technology stack to screw your competitors, and non-technical people to include the entire legal system are clueless.

      I remember how Microsoft killed Netscape (the most popular web-browser in the early '90s) by introducing Windows 98 (that came bundled with Microsoft's own Internet Explorer). Also, Microsoft killed WinAmp (the most popular media player application during the 2000's) by introducing Windows XP (that came bundled with Microsoft's own Windows Media Player).

      The lawsuits against Microsoft are just stupid. Competitors suing because their software was NOT INCLUDED with Windows 95. IE - Netscape, Realplayer. Any competent computer user could easily go to those companies respective websites and DOWNLOAD the software to install it if they wanted to. But instead these companies filed a lawsuit 'on behalf of the consumer'.

      Have you ever gone to a McDonalds and tried to order Pepsi? You can't do it! McDonalds has a deal with Coke and you can only order coke products to sate your thirst. Oddly enough no-one has filed a lawsuit on behalf of the consumer.

      Did you ever notice how some Supermarkets have refrigerators full of coke products at the check out line and not Pepsi products? I asked a friend of mine who was a manager at a store and he said the company signed a deal to only allow coke products to be refrigerated at the check out line. If I wanted a cool Pepsi product from the store I was out of luck.
      Again - no-one is filing a lawsuit on behalf of the consumer!

      Naturally none of this really bothers me, I just drive to the gas station and select my nice cool beverage of choice - RC Cola - and continue on my way.

      WP worked just fine on my 8.0 OS Mac laptop in 1997. In fact, I still have all 4 floppy discs in my bottom desk drawer. Anybody want them??

      It is kind of interesting that many of the people commenting here were not even born when windows 95 was released. At that time frame there was the beginning of the internet and people were coming out with all kinds of new software companies. Many of these companies were trying to jump into the Microsoft market but they just were not good enough and when they failed many started to accuse Microsoft for Monopolizing the industry. True or not, many of these companies were making software for older windows versions. Everyone today knows that each time a new Microsoft version is released, there are many older programs that no longer work. I also have been angry for having to go and buy a new cam, printer, drawing boards, zip drives, and software i use and it is not cheap. The problem is Microsoft knows they have the upper hand and they do not care about any other company.
