    Prosecution readies over 100 witnesses

    MANILA, Philippines - More than 100 individuals, including five Supreme Court (SC) justices and journalists, are being eyed as prosecution witnesses in the impeachment trial of Chief Justice Renato Corona.

    The prosecution panel, led by Iloilo Rep. Niel Tupas, hopes to have the witnesses testify against Corona for culpable violation of the Constitution and betrayal of public trust.

    In compliance with the order of the Senate impeachment court, the prosecution panel submitted a 39-page list of possible witnesses as well as documentary evidence that it wants to present during the impeachment trial.

    The list was submitted to the office of Senate secretary Emma Lirio-Reyes, who is also the clerk of court of the impeachment court.

    Sen. Miriam Defensor-Santiago earlier castigated Tupas for not having a list of witnesses. The incident prompted Enrile to order the prosecution panel to prepare one.

    “The prosecution reserves the right to present additional documents and witnesses, or to dispense with some of the identified documents and witnesses, during the course of the trial, as the need arises or as may be subject to stipulation,” the panel told the Senate.

    The prosecution’s long list of witnesses was in stark contrast to the defense lawyers’ reported 25 witnesses. Corona’s defense team is led by former Supreme Court justice Serafin Cuevas.

    There are eight Articles of Impeachment against Corona transmitted by the House to the Senate in December.

    A list emailed to reporters showed the prosecutors plan to present SC justices and several journalists when they take up Article 7 that accuses Corona of “partiality” in granting a temporary restraining order (TRO) on the travel ban on former President and now Pampanga Rep. Gloria Macapagal-Arroyo and her husband Jose Miguel Arroyo issued by the Department of Justice.

    The TRO would have allowed Arroyo to leave and seek medical treatment abroad.

    Aquino administration officials, however, believe Arroyo wanted to leave the country to escape prosecution for electoral sabotage.

    The panel wants to present Associate Justices Ma. Lourdes Sereno, Presbitero Velasco, and SC spokesman Jose Midas Marquez. Velasco and Marquez were listed as hostile witnesses. Velasco will be asked to testify on reports that Corona made handwritten corrections on the resolution that the former wrote in granting the TRO. Marquez will be asked to comment on allegations that he suppressed Sereno’s dissenting opinion. Among the journalists the prosecutors want to invite are Raissa Robles, Criselda Yabes, Marites Vitug, Zen Hernandez, and Ina Reformina.

    Robles, Vitug and Yabes will be asked to testify on the close relationship between Corona and Arroyo.

    For Article 3 or the alleged flip-flopping of SC on decisions under Corona, SC Associate Justices Roberto Abad, Diosdado Peralta, Jose Perez, Lucas Bersamin, Jose Mendoza, Bienvenido Reyes, Martin Villarama, Estela Perlas-Bernabe, and Sereno may also be asked to testify.

    The prosecutors also want Justice Secretary Leila de Lima to testify in the trial along with Arroyo’s personal physician, Dr. Juliet Gopez-Cervantes, and Dr. Mario Ver, the lead surgeon that operated on the former leader’s troublesome cervical spine.

    Also being eyed as prosecution witnesses are Marianito Dimaandal, head of Malacañang’s records office; lawyer Enriqueta Vidal, SC clerk of court; Lauro Vizconde; Dante Jimenez; and representatives and/or officials of MegaWorld Corp., Commission on Audit, Judicial and Bar Council, John Hay Management Corp., National Statistics Office, House Land Use Regulatory Board, Bank of Philippine Islands, Philippine National Bank, Land Bank of the Philippines.

    An official of the World Bank may also be asked to testify on the alleged misuse of loan proceeds by Corona, the prosecutors said.

    “Oh my God!” Senate President Juan Ponce Enrile, the impeachment court presiding officer, said yesterday when told of the prosecution panel’s plan.

    “Well, as I told you from the very beginning, I cannot say with certitude how long or how short this case will take. It will depend upon the lawyers, you see,” he said.

    No delays

    Enrile, meanwhile, said it would be up to Corona’s lawyers and the House prosecutors to disprove or prove the eight Articles of Impeachment, but stressed he would never tolerate delaying tactics.

    “I, as a presiding officer, would not control, will not control the amount, the number of witnesses, the number of documents that each side would present, but I will apply the rules so that delays will not be used to hamper the progress of the hearing. Unnecessary delays will not be tolerated,” he said. 

    “I do not control the manner of proving the case of any side in this proceeding. I do not know about the impeachment court, if they can control,” he added.

    Enrile declined to comment further on his concurrence with the defense’s stand that Article 2 is “defective,” and that there was “multiplicity” of charges in the same Article of impeachment.

    “I cannot make a judgment. Not yet. Don’t ask me about acquittal or conviction because the trial is not over yet. I will emphasize, I will not want to discuss any acquittal or conviction, the trial is going on. Under the rules of the Senate, we will try the case until it is completed,” he added.       Why are the leftists siding with the prosecution and paradoxically NOT siding with the Hacienda farmers? Because they know that the only sure outcome of this circus will be division and destabilization. Everybody is enthusiastically riding on this circus-bandwagon but forgetting that this all started because of the tantrums of BoyNoy against Corona. Everybody has turned into circus animals dancing to the Cojuanco's music. Does anybody really believe that this matter will be peacefully settled whatever the decision? BoyNoy has divided the nation because of his shallow personality and utter lack of ability to lead.

      Now we can compute how long it would take to finish this impeachment case........
      100 witnesses at 1 witness per day......not counting the documents..... Impeachment court held 3session per week from 2pm to 5 pm..... Not including cross-examination from the defense and the defense own witness , and prosecution cross-examination of the defense witness.... Defense have 15 witnesses.....
      There are 52 weeks in 1 year..... X 3session per week = 156 sessions
      Assume 1witness per day for the direct and cross-examination and re-direct exam..... Add all the witness from prosecution and defense 100 + 15 = 115 session
      300 pieces of documents to be presented by the prosecution..... Lets say 10 document to be presented per day to be argued upon...... That used up 30 sessions.....
      Total sessions to be use = 145 sessions at least from the time the first of the 100 witness take the stand........ Current session used up not counted....... If the senate as impeachment court did not have any recess and go full time ....... This thing will last till next january 2013 ........... If the impeachment court have any easter, november, christmas break...... This thing will reach next march 2013.......
      And those running for senate re-election will not want that to happen...... To give those prosecutors who have senate ambition to have free airtime

      parang hardware. kahit konti ang kita basta madami, okey na. sa impeachment, kahit konti lang ang madagdag na information sa case, basta madami ang testigo, okey na din. ikampanya nalang sa labas ng court room para magresign si Corona. may papalit naman kagad eh. kinukondisyon na naman ang bayan ng ganitong sistema.

      kung may technicalities, overcome it! wag nang magreklamo dahil part yan ng batas. rule nga yan eh. yung iba ayaw sumunod sa technicality ng case basta makakuha daw ng katotohanan. parang traffic light, kahit mali, kotong, reckless basta makarating lang sa pupuntahan, okey na. no wonder, tayong mga Pilipino ang pinakahindi sumusunod sa batas! sa voting nito, ang mga marunong sumunod sa batas na senador ay boboto ng acquittal. yung hindi marunong sumunod sa batas ay guilty naman ang boto! di lang si corona ang nasa trial nito. lahat ay involve dito. ang presidente dahil sa hacienda luisita, ang mga senador dahil malapit na ang election, mga congressman, mga lawyers, etc. lahat sila ay binatantayan ng bayan. kung ma-acquit si corona, sigurado may epekto yan sa liderato at dignidad ng presidente.

      What a waste of time this prosecution team is doing. Wala na silang inatupag kundi ito, Marami tayong problema sa bansa, Yan ang tutukan nila.       Your case is only as good as your lawyer.

      Kahit kumuha ka ng isang bilyon na witness, kung hindi magaling ang lawyer, sayang lang. I doubt kahit 25% lang nung 100+ na witnesses na yun mapapakinabangan nila.

      Ano daw 100 more witness para sa prosecution. Maawa naman kayo! kahit na 5 lang basta talagang may ebidencia ok na yon. Ang ginagastos ng goberno ay mga 5 - 10 million pesos bawat araw ng impeachment trial ayon sa balita, kung abutin ng isang taon yan, napakalaking pera na ang sinayang para diyan, pera ng taong bayan ang ginagastos diyan.

      wow more than 100 witness?? maliwanag na walang kwenta ang prosecution..bakit kailangan mo ng maraming witness kung patunayan mo lang na guilty si corona. ibig sabihin mahina ang kaso kaya sandamakmak na witness..wasting money and time sa senado..kung walang mangyari dyan dapat bitayin ang nagsulong ng impeacment na yan..

      Think out of the box’

      Te, who is in the United States on a scholarship, also questioned why the prosecution would need around 100 witnesses.

      He said it is indicative of two things.

      “It believes that its case is so weak that it needs that many witnesses to prove something that should be, on its face, already self-evident, and it hopes that, along the way, someone will do a Clarissa Ocampo and turn the tide irreversibly in its favor, ” he said.

      Ocampo was the whistle-blower who said that then President Joseph Estrada was the one who signed the “Jose Velarde” accounts, where jueteng money was supposedly deposited.

      “Either way, it doesn't look good for the prosecution simply because disclosing its own belief that it takes that many witnesses to prove that Corona is unfit to continue as Chief Justice sends to the Senate the wrong message--that perhaps the truth isn't as clear and that perhaps the doubt should be resolved in favor of retaining him in office, ” Te said.

      He said it’s not too late for the prosecution to rethink its strategies.
