    Prosecution stopped from presenting PAL witness

    Enrile losing patience

    The impeachment court on Tuesday disallowed the prosecution from presenting an official of the Philippine Airlines as witness.
     
    The prosecution was supposed to present PAL Vice President for Sales Enrique Javier as witness for Article III of the impeachment complaint which pertains to Chief Justice Renato Corona’s alleged failure to act with competence, integrity and independence as a member of judiciary.
     
    The witness' testimonies was supposed to prove that the Corona and his wife received special privileges and free travel benefits while the Flight Attendants and Stewards Association of the Philippines (FASAP) vs. PAL case is still pending, the prosecution added.
     
    Lead defense counsel Serafin Cuevas, however, pointed out that they have filed a motion to quash the request for subpoena addressed to Javier, noting that his testimonies will be irrelevant to Article III.
     
    Senate President Juan Ponce Enrile, presiding officer of the impeachment court, agreed and ordered to discharge the PAL official.
     
    Private prosecutor Atty. Marlon Manuel continued to justify Javier’s appearance saying that his testimonies “will help establish the partiality of Corona in favor of PAL.”
     
    “But you did not allege that in your article of impeachment! There must discipline in this court,”
    an obviously irritated Enrile said.
     
    The presiding officer then enumerated allegations included in Article III such as “allowing the SC to act on mere letters filed by a counsel which caused the issuance of flip-flopping decisions in final and executory cases; creating an excessive entanglement with Mrs. Arroyo through her appointment of his wife to office; and discussing with litigants regarding cases pending before SC.
     
    Enrile however pointed out that nowhere in the article did the prosecution accuse Corona of receiving facors and gifts.
     
    “Now you’re expanding the allegations in this article. The court would not allow any expansion of allegations unless you amend your articles,” Enrile told Manuel.
     
    “I've warned you several times that there's something wrong with your articles of impeachment. There's a limit to the patience of this court,” he said.
     
    But lead prosecutor Iloilo Rep. Niel Tupas Jr. still took the stand and appealed to the court to reverse its decision.
     
    “The very heart of Article III is integrity. To us, it’s important to prove the motive of the chief justice in the flip-flopping of the FASAP case,” Tupas explained.
     
    Enrile then stressed that the prosecution should amend the impeachment complaint and accuse Corona of bribery.
     
    “I'm basing my ruling based on your allegations.  Mr. Counsel, I don't know where you learned your art of pleading. If you are going to insist with your position, I will say that I will not change the ruling,” Enrile told Tupas.
     
    Tupas replied that they won’t amend the complaint saying that technicalities should not be permitted to delay such significant case.
     
    Enrile, already losing patience, said that the rules for the grounds for impeachment are clearly stated in the Constitution.
     
    “For heaven's sake! This is not just a technicality! We've already been very liberal but you're going too far. Do you want me to lecture you more?” he told Tupas.
     
    “This presiding officer has been very lenient but there’s a limit to what this chair can do. If your articles of impeachment are defective, that’s your responsibility,” Enrile added.
     
    Despite the ruling of the court, Manuel enumerated the PAL platinum card benefits Corona allegedly received which the witness was supposed to present.
     
    Cuevas moved to strike Manuel’s statements out of record when Enrile told the lead defense, “You and I both understand that this evidence is nothing. Let it remain as a manifestation of counsel and we'll discuss this in due time.”
     
    The presiding officer then called for the next witness but the prosecution asked that the hearing be continued tomorrow.

        Hindi lang ikaw, ako rin. Kaya natatawa ako dahil sa kabobohan ng mga nasa Prosecution na padalos-dalos nakagastos tuloy ang Pilipinas ng malaki sa walang kabuluhang impeachmnt trial. Sana naman maging maingat sa susunod. Hindi dahil may numero in the bag na ang panalo. Sorry lumaban kasi si Corona, kaya nataranta sila dahil wala silang bala.

      We should remember that at this stage of the impeachment proceeding we are only hearing one side of the story, that is of the prosecution side. Let us wait until the defense also lay down there story. After hearing both sides, then let us decide. If you want to have a wise judgment on the matter, let us just focus on what we gather from the impeachment trial. Exclude those we heard from the 'outside' as those information are being floated by either sides to confuse us and put us in situation to render inaccurate judgment fueled by emotion rather than reason. Para lang itong sa bahay natin, halimbawa nag aaway yong panganay at bunso nating mga anak. Para malaman natin ang pinagmulan ng away, sympre tatanungin natin ang bawat isa sa kanila. Hinde naman pwede na habang nagsasalita pa yong bunso at sinasabi kng bakit sila nag aaway ay bubuo na tayo ng conclusion na si panganay ang may kasalanan kahit hindi pa natin narinig ang kanyang panig.

      Ano na ba ang nangyayari sa bansa natin? Si Pres. Noy sana economic reform na lang ang atupagin wag na makisawsaw sa impeachment trial! Pabayaan na lang ang impeachment court magdecide kung ano ang gagawin nila sa kaso ni Corona. Ang gawin nya ay i-justify ang trilyun-trilyon na inutang nila. Ni-wrestle at in-overpower nila ang Senate sa Debt Cap. Kaya walang habas na ang pangungutang ng gov't natin! Hanapin at i-trace ang money trail ng trilyones na nautang, inutang at uutangin pa! Sino at anong ahensya ng gobyerno ang nakinabang nito? Ganito rin ang ginawa ng mga emprors ng Rome noong araw para pagtakpan ang pag kukulang nila- nagpapalabas ng labanan ng mga gladiators para makalimutan ng masa ang tunay na problema ng bansa. Sa personal na bagay mabilis umakto si Pnoy pero sa mga bagay na mahalga ang hina nya tulad ng poverty alleviation, mag-create ng work sa masa,o bumisita at bigyan ng pangmatagalan na solusyon ang pangkabuhayan ng mga nasalanta ng baha at lindol. Sana maging dignified stateman sya at d tumalak tulad ng isang baklang babae. Si Ramos inangat nya economy natin at sinolusyunan ang power crisis. Sa panahon ring eto panay expose ni Maceda noon pero d nya ito pinansin at nagpatuloy lang syang magtrabaho. Be gracious and generous in times of victory wag maging vindictive.       pipol, pls try to understand what Enrile is trying to say (and he is right) the case was about article 3 which is betrayal of public trust.. but there are many examples of what constitutes a betrayal of public trust.. so its the PROSECUTIONs JOB TO STIPULATE THOSE IN THEIR ARTICLES OF IMPEACHMENT.. and to every allegation they make... they should present evidences or witnesses in connection to that allegation... take note.. wala po silang nilagay about BRIBERY.. kaya hindi sila pwedeng maglagay ng witness nor submit any evidences about bribery owing to the fact the PROSECUTION ITSELF NEVER MENTIONED ANY CASE ABOUT BRIBERY.. that is why Énrile said "You want us to accept your witness, then amend ur articles of impeachment". That is why not even a single senator judge contradicted to his ruling. He was right, plain & simple.

      and HeS damn right to say it is not the impeachment court to be blamed because it was the (again & again & again & again) ProsecutionS negligence& fault.. again, it shows how incompetent these prosecution panel is... that goes to the saying HASTE MAKES WASTE..

Im not Anti-aquino nor Pro-corona.. intindihin po na lang natin in any trial.. meron silang sinusunod na rules & regulations.. everything must be done in accordance with the law.. so tayo pong walang alam sa court proceedings, wag po tayong banat ng banat dahil nakakahiya.. hayaan muna nating gawin ang trabaho nila.. pag meron nang resulta at hindi nyo nagustuhan.. SAKA NYO TIRAHIN!!!... peace...

      JPE clearly knows what he is talking about. The man was voted as the Senate President for something. The prosecution must have studied their case before the trial. Nagmumukha lang silang mga walng alam. Nafufrustrate natuloy ata si Senator Enrile at parang gustong ibalik sa law school ang mga taga prosecution.
