    SC justices to hold special session on Corona impeachment issue

    Justices of the Supreme Court will hold a special en banc deliberation Thursday to discuss the House prosecution panel’s request for the Senate impeachment court to summon a number of them and certain documents during the trial of Chief Justice Renato Corona.

    The special session will start at 2 p.m. on Thursday, based on a consensus reached by the SC justices at the end of a an en banc meeting Tuesday, said SC spokesman and administrator Jose Midas Marquez.

    The session on Thursday will delve into the policy the Supreme Court will adopt once the individual justices receive their respective subpoenas and if they will attend the Corona trial, considering that the impeachment case may eventually reach the high tribunal, according to the administrator.

    The special session is necessary for the justices to have ample time to deliberate on the issue at hand, he added.

    “This was taken up this morning, but they had to resume deliberations because some reflections or views are still being circulated,” Marquez noted, saying, “Some justices are submitting written views and all these views have to be consolidated and would have to be deliberated upon again.” A definite stand

    “My understanding is that, they don’t want to wait for next Tuesday anymore because the subpoenas may be issued right away and there might not be sufficient time if they wait for Tuesday…” Marquez added.

    The high court is in the process of taking a definite stand on issues related to the impeachment trial, the court administrator said, as “(it) goes to the very essence of the separation of powers among co-equal branches of the government and the matters that the justices can testify to.”

    The chief justice will not attend the special session, and Associate Justice Antonio Carpio will likely take on the role of presiding judge, Marquez noted.

    The prosecution team requested the Senate to summon SC justices — including Associate Justices Presbitero Velasco Jr., Martin Villarama, Maria Lourdes Sereno and Bienvenido Reyes — to the Corona trial and serve as witnesses under Article 3 of the impeachment complaint.

    In Article 3, the prosecution complained Corona committed culpable violations of the Constitution and betrayal of public trust by failing to meet and observe the stringent standards of Article VIII, section 7 (3) of the Constitution that states, “[a] member of the judiciary must be a person of proven competence, integrity, probity, and independence.” — VS, GMA News

        if I am right, this is the case involving the representative ecleo, jr. and if I still remember right, congress was still in session when the case was in progress. If I may, congress (senate and the house of rep) has parliamentary immunity over cases filed against them for as long as the case's maximum penalty for imprisonment is below 6 years. Ecleo, Jr., the House of Rep. surrendered Ecleo, Jr. when Congress was no longer in session. parliamentary immunity takes no effect over cases whose max. penalty of imprisonment is 6 years above.

      Our constitution must be followed, in the impeachment court who is the SUPREME COURT? the supreme court or the impeachment court, this should be clarified and the Flipino people should educate which is which or who is who. The constitutional crisis is just around the corner if this question is unresolved. The bank secrecy law must amend first before the impeachment decided to this issue, otherwise that is another treat to our constitution. I strongly suggest that Pnoy should stop this impeachment case in order for him to have a MATUWID NA DAAN otherwise Pnoy should go back to TARLAC. MABUHAY PO TAYONG MGA PILIPINO

      Itong mga senator Judges na ito kung talagang ayaw ninyong respetuhin ang supreme court,wag kayong mag bigay ng JURESPRUDENCE na nanggaling sa Supreme court, gumawa kayo ng interpretasyon ninyo, mga hangal!!! tingnan nating kundi ba kayo jan magkagulo... Mga GAGO!!! Nakaka inis na kayo, puro lang kayo pasikat!!

        Hindi naman ang Supreme Court ang nirerespekto dito sa impeachment na ito. Ang dapat respektuhin yung sinasabi ng Constitution na separation of powers. Kaya hindi dapat makialam ang SC dito sa usapin na ito. Ang mandate na ayon sa Constitution ay ibinigay sa Senado para sa kapangyarihang maghearing sa anumang kasong impeachment at walang binanggit ang Constitution na makialam ang Supreme Court dito. Ito po ang sabi ng Constitution tungkol dito.

        ARTICLE XI
        ACCOUNTABILITY OF PUBLIC OFFICERS
        (6) The Senate shall have the sole power to try and decide all cases of impeachment. When sitting for that purpose, the Senators shall be on oath or affirmation. When the President of the Philippines is on trial, the Chief Justice of the Supreme Court shall preside, but shall not vote. No person shall be convicted without the concurrence of two-thirds of all the Members of the Senate.

      I must say, I am for acquittal of our CJ Corona( hope & pray to cleanse our judicial institution). However I fully submit whatever conviction it may be. To be fair, i'm not after of how good the defense lawyers are, but for the truth to come out. This is not the battle of good lawyers. My belief will solely rely on the outcome of this trial and based on the substantial evidence presented will prove or disprove my belief. I believe that the impeachment court is clash of its own and definitely not a judicial court in which senator judges can possibly be non-lawyers. Therefore, total legalities or technicalities is not substantial or apprehensive in this proceedings and conviction will entirely rely on the appreciation of every senator judges.

      midas hudas marquez, how could you say that there must be separation of power of equal branches of government when you are putting the supreme court above the impeachment court where the senators stand as judges and has the sole authority to remove persons such as cheap corona for breach of public trust, violation of the constitution and graft and corruption which he is guilty of for unexplained wealth (nakaw na yaman) at maliwanag pa sa buwan. ito ang isipin ninyo sa supreme court na kayo ay hindi niluklok sa mga puwesto ninyo ng mamamayan but were put by individuals with ulterior motives to the detriment of the people at large kaya yung mga decisions ninyo are questionable para maprotektahan ang katulad nina cheap corona, gloria labandera, ligot, garcia, reyes et al na magsamantala sa kaban ng bayan. makapal ang mukha ni cheap corona. sa ibang lugar na mas developed pa sa atin ay may kahihiyan kaya agad nagreresigned. dapat kay cheap corona ay mag harakiri katulad ng mga hapon na tuwing mapahiya sa mga kasalanang ginawa ay nagpapatiwakal. one example which happened two days ago in India where this japanese national who was involved in olympus financial scandal hanged himself. ganun dapat ang gawin mo cheap corona. sa maka-corona buksan ninyo ang mga mata ninyo at alisin ninyo sa sarili ninyo ay may tendency to do what corona is being charged of.
