I AM SURPRISED AT HOW EVERYBODY SEEMS TO HAVE MISSED THE POINT WHY THE DOCUMENT THAT WAS MADE THE BASIS OF THE SUBPOENA HAD TO BE FAKE!

IF IT WERE GENUINE, THEN ANY INFORMATION TAKEN FROM IT WOULD HAVE BEEN INADMISSIBLE AS EVIDENCE ONCE FORMALLY OFFERED, BECAUSE THEY WOULD BE INFORMATION GATHERED IN DIRECT VIOLATION OF THE BANK SECRECY LAW. REMEMBER "THE FRUIT OF THE POISONED TREE' THEY ARE SO FOND OF POINTING AT?

SINCE IT ADMITTEDLY IS FAKE, THEN IT IS A DOCUMENT NOT ISSUED BY THE BANK AND, THEREFORE, NOT FROM THE BANK. THERE IS NO VIOLATION OF THE BANK CONFIDENTIALITY LAW! INFORMATION EXTRACTED FROM IT CANNOT BE SAID TO BE INFORMATION OBTAINED IN VIOLATION OF THE LAW. THE INFORMATION CANNOT BE CATEGORIZED AS THE "FRUIT FROM THE POISONED TREE!"

WHILE THE DOCUMENT IS BY ITSELF INADMISSIBLE FOR BEING FAKE (UNLESS USED IN THE PROSECUTION OF THE PERSON WHO FALSIFIED IT), THE BANK ACCOUNT NUMBERS THEREIN WRITTEN WERE EXPRESSLY ADMITTED BY THE BANK PRESIDENT AND, SUBSEQUENTLY, BY THE BRANCH MANAGER TO BE EXISTING IN THEIR BANK'S RECORDS AND CORRESPOND TO THE BANK DEPOSIT ACCOUNT NUMBERS OF CJ CORONA! THEY ARE, THEREFORE, TRUE AND ACCURATE INFORMATION FURNISHED BY THE PROSECUTORS TO THE IMPEACHMENT COURT WHEN THEY (PROSECUTORS) REQUESTED FOR A SUBPOENA DUCES TECUM. THE SUBPOENA WAS ISSUED BASED ON CORRECT INFORMATION! THE IMPEACHMENT COURT WAS NOT MISLED, AS SEN. ___ SANTIAGO AND OTHERS WOULD HAVE US BELIEVE.

This is actually a huge incompetence by the senate impeachment court. Before doling out and even defending a subpoena that would wreak havoc to the countries' banking industry they should've ensured first that the document they are basing their subpoena on is fake or not. They should've first subpoena'd the original document along with pertinent connected documents before generalizing ALL records indicated in the document to be subpeona'd. And then ngayon when the bank in question is denouncing the document, they suddenly admonish the prosecution for offering fake evidence, where as they had the power to verify it in the first place, BEFORE making a decision that would affect the whole banking industry in the Philippines.

seems all prosecution had were account numbers which could easily be obtained from checks issued. then they made fake account statements (all they needed were the true account numbers from checks issued). Then they issued a sobpoena.
Tutuo lang, ang palpak ng prosecution. Parang minadali lahat kaya mali mali. If all they had were fake docs and submitted them as evidence, drop na kaso nito. Kakahiya.....

Dissecting the testimonies: Branch Manager - " they are NOT FAITHFUL reproduction of the ORIGINAL DOCUMENT. Bank President - the BANK ACCOUNTs indicated in the leaked documents EXISTED.
Are the statements of the Branch Manager and the Bank President conflicting or are suppletory to one another? President says the account exists and the Branch Manager says the content of the account is not the "faithful" reproduction of the original.
Rationale for the Prosecution's presentation of the "tampered" documents.... "they want to open a gift wrapped box belonging to another person but in order to open it forcefully they implied that there is a bomb inside it." Fortunately, there are laws that protects everybody against unscrupulous and abusive exercise of authority.
Is it lawful to present "UNFAITHFUL REPRODUCTION" of the original document as evidences in any proceeding?

Baka sinabi lang ng witness na fake para di sumabit ang kung sino man sa PS Bank! The senate should have clarified kung fake o di lang faithful reproduction as Reggie said and checked the original as against the prosecution's documents.

One rule in the application of Law is consistency, consistency of evidence and statements. The prosecution seems to have created the game, started the game. Yet on game time forgot to bring their A game... Too bad tsk tsk or shall we say such a pity. Even if they have the truth on their side (granting), simply they are losing it Big Time. I am no fanatic of CJ, but let's all face it... This impeachment case is ILL Prepared... Defense wins!
