Badian orders construction of beach cottages in Lambug stopped

THE Badian Municipal Government has ordered a developer to stop the construction of beach cottages in Barangay Lambug.

Mayor Carmencita Lumain issued the cease-and-desist order (CDO) against Benjamin Martilino Chan on Aug. 19, 2022, based on the recommendations of Municipal Engineer Vicente Jojie Nillas.

"Our records show that no building permit has been issued by the Municipality of Badian, Cebu regarding your said construction. Hence, the same is illegal,” the order stated.

The mayor gave Chan 10 days to explain why the project should push through. However, the developer has yet to show up at the Office of the Building Official.

Nillas said they’ve received reports that construction continues, albeit sporadic.

He said the Municipality received a complaint against the project from Redwood Heritage Land Holdings Corp. last March.

“It seems that they have conflict over boundaries of their respective properties,” he said.

During a site inspection, municipal officials discovered that aside from violating the building code, the cottages were being built inside the 20-meter easement zone.

"The root cause is the violation of Nipas (National Integrated Protected Areas System) Law. If the structures are built in environment protection area, we cannot issue a building permit,” Nillas said.

The Badian Municipal Government is waiting for a court order to demolish the illegal structures.

The third-class municipality in southwest Cebu Province is located 97 kilometers from Cebu City. It is famous for Kawasan Falls and canyoneering activities, which attract local and foreign tourists. (BBT)
