Tanauan, Leyte - The Comission on Elections (Comelec), first division, based in Manila has dismissed the disqualification petition filed against a mayoralty candidate of this town.
Comelec resolution SPA no. 13-207 (DC) (F) signed by first division presiding Comissioner Lucenito Tagle resolved to deny the petition to cancel certificate of candidacy and for disqualification filed by Mr. Claudio Sabido, Jr., against Pelagio Tecson, Jr. , a mayoralty candidate of this town for "lack of merit."
Mr. Sabido alleged in his petition that Tecson lacks residency requirements as provided for by law. However, the Comelec resolution said Sabido failed to show in his petition that Tecson "lacks the residency requirement provided for in the Local Government Code."
The Comelec resolution further said that Sabido's petition violated Comelec Resolution No. 9523 as it was filed two months late from the period as mandated by Comelec and it also combined the grounds for the petition to "cancel certificate of candidacy with that of a petition for disqualification."
