Explain iPad Promo, Jamby Told

Despite her public apology, senatorial aspirant Jamby Madrigal is still not off the hook as far as the Commission on Elections (Comelec) is concerned as she will be asked to shed light on her iPad promo online.

Comelec-Law Department Esmeralda Ladra said they will be asking Madrigal to explain her side officially to the poll body.

"We would like her to give us an explanation why we should not file a case against her... we will be sending her a notice," she said.

"We want an explanation in writing," added Ladra.

Section 97 of the Omnibus Election Code states that "it shall be unlawful for any person to hold dances, lotteries, cockfights, games, boxing bouts, bingo, beauty contests, entertainments, or cinematographic, theatrical or other performances for the purpose of raising funds for an election campaign or for the support of any candidate from the commencement of the election period up to and including election day".

Section 261 of the Code also defines vote-buying as "any person who gives, offers, or promises money or anything of value... directly or indirectly... in order to induce anyone or the public in general to vote for or against any candidate".

"At this time kasi, all our resolutions have been published so the presumption is everyone already knows what the law says," said Ladra.

Violation of election laws could be tantamount to an election offense, which carries a penalty of one to six years imprisonment, removal of right to vote, and prohibition to hold public office.

Ladra, however, admitted that they will be considering the facts that she has already removed the contest in her Facebook and Twitter accounts and her issuance of an apology.

"We are studying since she removed it right away when she heard what the chairman said...so we are still studying if her sorry is already sufficient."

Comelec Chairman Sixto Brillantes had earlier disclosed that they are studying the possibility of filing an election offense against a senatorial candidate of Team PNoy for offering an iPad to the public via an online contest.

Immediately after news broke out, the contest was taken down online with Madrigal's counsel, Ernesto Francisco, saying her client has already apologized.
