Harvey Weinstein's lawyer says sexual consent contracts are a good idea

After handing himself in to a New York police station in May 2018, following multiple accusations of rape and sexual assault, Harvey Weinstein's ongoing legal case has been high-profile news. Now, his attorney Donna Rotunno, who is defending him against five counts in total (including a forced sexual act in 2006 and rape in 2013) is making headlines of her own. She recently made some controversial comments on the New York Times' Daily podcast, in an episode called 'The Woman Defending Harvey Weinstein'.

Host, journalist Megan Twohey, who played a part in breaking the story on Weinstein's alleged sexual assaults, asked Rotunno if there's anything that men should be doing differently today when it comes to sex. In response, Rotunno made some pretty unorthodox remarks around the issue of consent. "If I was a man today in today's world, before I was engaging in sexual behaviour with any woman, today, I would ask them to sign a consent form," she said.

When asked if she was serious, Rotunno confirmed she was, "I’m being dead serious. I’m being dead serious. Because how easy is it for two people to engage in behaviour and a day later, two days later, five days later, 27 years later, somebody say, you know what? That’s not what that was. Why not? Take all of the question out of it. Make it easier on everybody."

Of course, it doesn't take a genius to work out that there's a few serious flaws with that logic – one being that a woman (or man) could be forced into signing a contract agreeing to a sexual act. Equally, they could change their mind part way through, as is anybody's complete right.

The trial is ongoing, with Weinstein denying all the charges against him. The jury, comprised of seven men and five women, are expected to begin deliberations next week.
