Kentucky vs.Team Kentucky

On March 26, 2020, the State of Kentucky filed with the US Patent and Trademark Office an application for the registration of “Team Kentucky” as a trademark for “clothing, namely, t-shirts, sweatshirts, polo shirts, dress shirts, jackets, sweaters, golf shirts, cardigans, pants, shorts, sweat pants, socks, hats, caps being headwear.” The State also has a separate trademark application for “Team Kentucky” for “Face coverings being sanitary masks for protection against viral infection.”

The usnews.com website reports that early this month, the University of Kentucky filed a notice of opposition to the “Team Kentucky” trademark application on the ground that as early as 1997, it has a trademark registration for “Kentucky” for athletic clothing. The University avers that the “Team Kentucky” trademark will likely cause confusion with its “Kentucky” trademark. State officials have until September 22 to file a response to the opposition.
