Repeat sex offender molested 14-year-old girl, told her 'you soon kena rape'

SINGAPORE — A man who molested a 14-year-old girl, and then told her that he would “take responsibility” by making her his girlfriend, was jailed for 10 months on Monday (15 November).

Xavier Lee Wei Jie, 30, also told the girl, “You soon kena rape (sic)” (you will soon get raped).

But this was not his first offence: Lee was jailed for a year in 2015 and for 20 months in 2019 for sexual penetration of a minor under 16. The victim in his 2019 conviction was also 14.

Lee, who is unemployed, pleaded guilty to one charge of molest. An additional charge of insulting her modesty and failing to wear a mask during the incident will be taken into consideration for his sentencing.

The girl, who was in Secondary 3 at the time of the incident, cannot be named to protect her identity. 

Facts of the case

The victim came to know Lee through another girl, who introduced them to each other. The girl, also aged 14, was friends with Lee.

On 30 July this year, the victim and her friend met Lee at the playground located at Block 283 Bukit Batok East Avenue 3.

At about 4pm, the two girls arrived at the playground dressed in their school uniforms. The victim did her homework while talking to her friend, who was seated on her left, and Lee, who was seated on her right while facing the victim. Lee’s mask was pulled down to his chin.

Lee then pinched the victim’s cheeks and touched her face and hand. Each time, the victim would push his hands away.

He then told the girl, “you soon kena rape”. The girl felt uncomfortable, as she knew that Lee had been convicted for sexual offences. 

Lee patted the girl’s head before standing up and going behind her to touch her. He brushed her chest, prompting the girl to move away. Despite that, Lee stood in front of her and brought his genitals near the girl’s mouth, indicating that he wanted her to perform a sex act on him.

He also invited her to his house or a staircase, but the girl refused.

That night, after the three had parted ways, the girl told Lee via Instagram that she was uncomfortable with his touches. Lee replied that he would not do anything from then on, and asked if he could take responsibility by making her his girlfriend. He added that he loved her.

The girl told her mother what had happened and filed a police report the next day.

After the girl filed a police report, Lee texted her and claimed that he was only joking. If the police asked about the matter, “say we playing bah”, he added.

Deputy Public Prosecutor Kathy Chu sought between eight and 10 months’ jail for Lee, who had exploited a victim who was vulnerable by virtue of her age. DPP Chu also confirmed that the offences had happened in the presence of the girl’s friend.

Mitigating in person, Lee said he felt "remorseful" and asked for leniency. 

District Judge Wong Li Tein considered Lee’s persistence in touching the victim, as well as his "unsavoury remarks" knowing full well her age at the time and his past sexual offences against minors. She also found it aggravating that Lee had offended in the presence of the victim’s friend, another minor.  

For molest, Lee can be jailed up to two years, or fined, or caned, or a combination of the penalties.
