THERE was a question by one of the columnists of this newspaper whether lawyers are authorized persons outside of residence. The short answer is: Yes, sir, they are. The government is enforcing rules and regulations in order to stop the spread of the Covid-19 and in doing so the law enforcers arrest violators. There are also those who were detained for violations of law not connected with Covid-19. The right to have a lawyer for these arrested individuals are not suspended because of the current situation. The right to counsel is guaranteed by no less than the Constitution of the Republic of the Philippines.
Knowing that violators need lawyers, the Inter-Agency Task Force for the Management of Emerging infectious Diseases (IATF) issued on June 15, 2020, Resolution 46 amending Section 2 paragraph 13 of the Omnibus Guidelines on The Implementation of Community Quarantine in the Philippines. Sec. 2, Par. 13 of the guidelines talks about those people who are exempted from the strict home requirements and this includes lawyers.
On the issue of sticker on the hood, on May 20, 2020, before IATF issued Resolution 46, the Office of the City Mayor of Cebu City already issued authority for lawyers to travel within the territorial jurisdiction of the City of Cebu for the practice of their profession during enhanced community quarantine period. One of the requirements on the side authorization is that there should be a WRITTEN INSCRIPTION on the conspicuous part of the vehicle, indicating the agency or institution.
I think lawyers do not want special treatment; they are just following the rules because they know it.
