Traveling in a fried-out Kombi

Volkswagen’s “KOMBI” is immortalized by the Men at Work song “Down Under” with its opening line: “Traveling in a fried-out Kombi.” Volkswagen registered with the EU Intellectual Property Office (EUIPO) a 3-D trademark of its KOMBI van which shows its front, back, side and perspective views. Volkswagen filed an Opposition to a trademark application of a logo which looks like the front view of the KOMBI: the front of the vehicle bears a split windshield, a curved V-shape design on the hood, and circular headlights on each side. The Board of Appeals of the EUIPO ruled in favor of Volkswagen stating that the opposed logo appears to be an almost identical copy of the front view of the Volkswagen brand and consumers will be confused into thinking that the opposed logo also emanates from Volkswagen.
