Tricycle driver freed after victim's family signs affidavit of desistance

A TRICYCLE driver who was involved in a vehicular accident that killed a 38-year-old motorcycle rider on Monday, September 19, 2022, in Barangay Balintawak, Talibon town in Bohol province, was freed by police after the family of the victim signed an affidavit of desistance.

The family of the victim, Roberto Balane, 38, reportedly a member of Alpha Kappa Rho (Akrho) fraternity and a resident of Purok 4, Barangay Santo Niño, Talibon, decided not to file a case against the tricycle driver, Mario Crisencio, 56, of Purok 2, Barangay Balintawak, after the latter promised to shoulder the burial and funeral expenses of the deceased, Police Corporal Joel Garcia of Talibon Police Station said in an interview with SunStar Cebu.

To recall, Balane was riding a motorcycle on his way home when he collided with the tricycle driven by Crisencio around 8:50 p.m. Monday in Barangay Balintawak.

Balane was attending a birthday party of his fellow fraternity member but left shortly after his wife called him to go home.

He collided, however, with the tricycle along the way.

Police said based on the accounts of Balane's wife, the victim might have been drunk during the incident as he was drinking alcohol before he went to the birthday party. (BBT, TPT)
